End User License Agreement

1. Scope

This End User License Agreement ("EULA") governs the YakiemBattle endpoint agents (the "Software") for Windows, macOS and Linux, including updates, and applies alongside the Terms of Service. The Terms of Service govern the Service as a whole; where they conflict, the Terms of Service prevail except as expressly stated here.

2. License grant

Subject to payment and compliance with these terms, we grant you a non-exclusive, non-transferable, revocable license to install and run one copy of the Software on each device for which you hold an active, seat-bound license key (a "Seat").

A Seat is bound to the device that first activates its key, by means of a hardware fingerprint. Each key is single-use and cannot be transferred to another device.

3. Permitted use

You may:

• install the Software on devices covered by active Seats
• receive updates, signature databases and behavioural feeds while a Seat is active
• transfer a Seat between devices you own, as described above
• make one archival copy for backup purposes, provided it is not installed or run

4. Restrictions

You may not:

• use a license key on more devices than the Seat count you purchased
• share, resell, rent or sublicense license keys or the Software
• reverse engineer, decompile or disassemble the Software, or attempt to extract its source code, except where mandatory law permits
• modify, patch or fork the Software, or combine it with other software to bypass its protections
• use the Software to harm, disable or overload third-party systems, or to process data you are not entitled to

5. Updates and telemetry

The Software may check for updates and transmit license validation and scan-status telemetry to our servers. This data is processed as described in the Privacy Policy. You can pause telemetry where the platform permits, with the caveat that some dashboard features rely on it.

6. Termination

This license remains in effect as long as your license key is active on a single device. It terminates automatically when: your Seat is revoked, your license key is consumed by uninstallation, or we terminate access under the Terms of Service. Upon termination you must uninstall the Software and delete all copies. The Software may disable protection functions once the Seat is no longer valid.

7. Warranty disclaimer

The Software is provided "as is" without warranty of any kind, express or implied. We do not warrant that the Software will detect every threat, that it will be error-free, or that it will operate uninterrupted. Security software reduces risk; it does not eliminate it.

8. Limitation of liability

To the maximum extent permitted by law, our liability arising out of or related to the Software is limited to the amounts you paid for the Seats on which the Software runs, in the 12 months preceding the claim. We are not liable for indirect or consequential damages, including data loss, even if a threat bypasses the Software.

9. Third-party components

The Software may include third-party open-source components. Their licenses are listed in the About dialog of the Software and, where required, in the distribution archive. Nothing in this EULA restricts rights you hold under those open-source licenses.

10. Governing law

This EULA is governed by the same law as the Terms of Service. If any provision is held unenforceable, the remainder continues in effect.
